LEGAL SERVICES AGREEMENT

 

This agreement is made on  February 15, 2022 between THE PEOPLE’S ADVOCATE (a Law Firm), located at 3595 Sheridan Street, Suite 103, Hollywood, FL 33021,   (Clients) whose address is and email is: .

  1.   Legal Services to be Provided.

Client(s) entered into one or more Timeshare Contract(s) to purchase a timeshare, vacation ownership and now desires to cancel, terminate, surrender or otherwise divest in Client’s ownership and contractual obligations to the    (Resort). This agreement confirms that you have hired The People’s Advocate as your Attorney to render legal services and negotiate a financial solution in order to terminate the financial and legal obligation with (Resort) with any financial reimbursement from the Resort to Client(s). Attorney shall provide those legal services reasonably required to represent Client's interests.

  1.   Attorney-Client Relationship.

This agreement confirms that an Attorney-Client relationship is created for the purposes stated in this agreement.

  1.   Legal Fee.

Client(s) agreed to pay a one-time nonrefundable legal fee of ($ INSERT LEGAL FEE), which is the basic fee in this matter, in consideration of my commitment to your case. This fee will cover my time negotiating and reaching a settlement agreement with Resort. The contracts do not include any work in court, any other court actions or proceedings; however, it may include filing complaints and negative remarks about the Timeshare. Client(s) understands that legal services will not commence unless contract fee mentioned above is paid in full.

  1.   Costs and Expenses.

Client(s) understands that the Resort, at their discretion, may charge an early termination fee, in which will be the Client’s responsibility. Attorney shall obtain Client's consent before hiring an outside attorney or co-counsel, consultant or expert witness, or prior to incurring any expense over $100 in the event that litigation is needed.

  1.   Responsibilities.

Law Firm will perform the legal services called for under this agreement, keep Client(s) informed of progress and developments, and respond promptly to Clients' inquiries and communications. (1) Client(s) will be truthful and cooperative with Law Firm; keep Law Firm reasonably informed of developments and of Client’s address, telephone numbers and whereabouts; (2) Client(s) agrees to deliver upon request any and all copies of all documents, correspondence and memos that in any way relate to the Timeshare Contract and/or Developer; (3) Client(s) agrees not to engage in any activity, communication or interaction with Developer or any person associated with the Developer; (4) Client(s) agree not to engage in any activity, communication or interaction for the purpose of terminating or amending the Timeshare Contract with any other firm or company without the prior written consent of the Law Firm; (5) Client(s) agree to cooperate with attorney and respond to attorney’s requests and communications; including but not limited to e-mail, facsimile, telephone, or any form of communication intended by the law firm in which Client(s) refuses or fails to respond; (6) Client(s) understand and agree that failure to comply to any requests mentioned above from Law Firm, will result in breach of contract and services may be considered rendered at the Law Firm’s discretion.

  1.   Acknowledgement.

The Client(s) acknowledges that the Law Firm has neither advised nor suggested the termination of payments to the timeshare resort; any ceasing of payment is wholly on the client(s) volition.

  1.   Discharge and Withdrawal.

Client(s) may discharge Attorney at any time. Attorney may withdraw with Client's consent or for good cause. Good cause includes Client's breach of the Agreement, Client's refusal to cooperate with Attorney, or any other fact or circumstance that renders Attorney's continuing representation unethical or unlawful.

 

IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed by their duly authorized representatives as of the day and year set forth above.

 

By signing below, Client(s) understand and agree to all terms and conditions disclosed above.
